Karts2Me
Last updated: October 5, 2026
⚠️ Recommended for attorney review before scaling. This document was drafted to be specific to Karts2Me's actual platform (arbitration-first, disclaimers folded into one liability section, opt-out mechanics) and reflects real, current business details. It has not yet been reviewed by a licensed attorney. Arbitration-clause enforceability, class-action-waiver validity, and liability-waiver scope are state-specific and litigated constantly — we recommend review by counsel licensed in every state Karts2Me operates in as the platform grows beyond an early pilot.
PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN AN ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO SUE KARTS2ME IN COURT OR HAVE A JURY TRIAL. SEE SECTION 2. THEY ALSO CONTAIN A WAIVER OF LIABILITY FOR INJURY, DEATH, OR PROPERTY DAMAGE ARISING FROM RIDES BOOKED THROUGH THE PLATFORM. SEE SECTION 8.
By creating a Karts2Me account or using the platform in any capacity, you acknowledge that you have read, understood, and agree to be bound by these Terms.
Before any account creation or ride activity, the app must show this document (or a clearly linked, unobscured summary with full text one tap away) and require an affirmative, unchecked-by-default checkbox:
☐ I have read and agree to the Karts2Me Terms of Service, including the Arbitration Agreement (Section 2) and the Liability Waiver (Section 8).
The app logs account ID, timestamp, and terms version accepted. Re-consent is required on any material change. A rider, driver, or operator who does not agree cannot proceed past this screen.
These Terms govern your use of the Karts2Me platform, which connects Riders with Drivers and Operators providing shuttle cart, shuttle, and similar low-speed vehicle transportation. Your agreement is with Q Squared LLC, d/b/a Karts2Me ("Karts2Me," "we," "us"). Karts2Me may amend these Terms at any time; continued use after a material change requires renewed acceptance. Karts2Me may suspend or terminate your account for violation of these Terms, safety concerns, or fraud. You may close your account at any time.
(a) Agreement to binding arbitration. You and Karts2Me agree that any dispute, claim, or controversy arising between you and Karts2Me — including disputes arising from or relating to a ride, an injury, or property damage — will be resolved by final, binding, individual arbitration and not in a court of law, except as set out in subsection (c) below.
(b) Class action waiver. You and Karts2Me agree that any arbitration or claim will be conducted on an individual basis only, and not as a class, collective, consolidated, or representative action.
(c) Exceptions. Either party may bring an individual claim in small-claims court. Nothing in this section prevents either party from seeking emergency injunctive relief in court where necessary to prevent irreparable harm while arbitration is pending.
(d) Right to opt out. You may opt out of this Arbitration Agreement within 30 days of first accepting these Terms by emailing support@karts2me.com with the subject line "Arbitration Opt-Out," including your name, account email, and a clear statement that you wish to opt out of arbitration. (A physical mailing address for written notice will be added here once Q Squared LLC's registered business address is finalized — until then, email is the designated method of opting out.) Opting out does not affect any other part of these Terms.
(e) Arbitration provider and rules. Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect (available at adr.org), except where those rules conflict with this Agreement, in which case this Agreement controls. The arbitration will take place in, or be conducted by videoconference/phone from, Hinds County, Mississippi, unless you and Karts2Me agree otherwise. Fee allocation follows the AAA Consumer Arbitration Rules' standard consumer-protective allocation. This provision has not yet been reviewed by counsel licensed in every state Karts2Me operates in; it will be revisited as the platform scales beyond an early pilot.
Karts2Me is a technology platform. It does not own, operate, or control any vehicle and is not a transportation carrier. Drivers are independent contractors or employees of an Operator — not employees or agents of Karts2Me. Karts2Me's role is limited to facilitating bookings, payments, and related technology described in these Terms.
Certain zones and events are configured, priced, and staffed by independent Operators (e.g., resorts, campuses, stadiums, HOAs) using the Karts2Me platform. Operator-set rules (including closed-fleet or verified-rider access requirements) are binding on you while in that zone or event. Karts2Me is not responsible for an Operator's own policies, staffing decisions, or on-site conduct, except as expressly stated in these Terms.
You must be at least 18 years old to register. You are responsible for the accuracy of your account information and for all activity under your account. Drivers must additionally meet the category-approval requirements in Section 6.
Drivers must be approved for each vehicle category they operate (e.g., Shuttle Cart, Shuttle Van, ADA Cart), which requires a valid license, proof of insurance meeting the category minimum, and a background check at the required tier. Drivers are solely responsible for their vehicle's condition and for maintaining insurance meeting or exceeding category requirements. Karts2Me does not provide insurance coverage to independent-contractor drivers and does not inspect vehicles beyond the approval process described above.
(a) Conduct. All users must comply with applicable law, this Agreement, and any zone- or event-specific rules. Prohibited conduct includes harassment, violence, discrimination, fraud, and circumventing the platform's safety or payment systems.
(b) Payment. Fares are calculated per the pricing displayed at booking and processed through Karts2Me's designated payment processor. Karts2Me and, where applicable, the relevant Operator collect a platform fee from each fare. Drivers retain 100% of tips. Split-fare participants are individually responsible for their share; a primary rider who elects to depart before all participants confirm is charged for unfilled seats.
(c) Cancellation. A Rider who cancels a ride after a Driver has been assigned may be charged a cancellation fee of up to $3.00, deducted from the refund of the original fare. Cancelling before a Driver has been assigned is free. A Driver who repeatedly cancels accepted rides may have their account reviewed or suspended under Section 1.
(d) Text messages. By providing a phone number and opting in at signup, you consent to receive transactional SMS text messages from Karts2Me (ride requests, status updates, and account notices) at that number. Message and data rates may apply. Message frequency varies. Reply STOP to any message to opt out at any time, or HELP for help. Consent to receive texts is not a condition of using the platform where an alternative notification method (push notification or email) is available.
(a) Assumption of risk. Riding in, driving, or being present near a shuttle cart, shuttle, or similar low-speed vehicle carries inherent risk, including collision, falls, weather and road/path conditions, and the conduct of other drivers or riders. By using the platform, you voluntarily assume these risks.
(b) Disclaimer of liability. TO THE FULLEST EXTENT PERMITTED BY LAW, KARTS2ME IS NOT LIABLE FOR ANY INJURY, DEATH, PROPERTY DAMAGE, OR OTHER LOSS ARISING FROM OR RELATED TO A RIDE BOOKED, GIVEN, OR FACILITATED THROUGH THE PLATFORM, INCLUDING THOSE CAUSED BY THE ACTS OR OMISSIONS OF A DRIVER, RIDER, OPERATOR, OR THIRD PARTY. THIS WAIVER DOES NOT LIMIT LIABILITY FOR KARTS2ME'S OWN GROSS NEGLIGENCE, RECKLESSNESS, OR WILLFUL MISCONDUCT, OR FOR ANY CLAIM THAT CANNOT BE WAIVED AS A MATTER OF LAW IN YOUR JURISDICTION. NOTHING HERE WAIVES ANY RIGHT YOU MAY HAVE DIRECTLY AGAINST A DRIVER, OPERATOR, OR THEIR INSURER.
(c) Limitation of liability. TO THE FULLEST EXTENT PERMITTED BY LAW, KARTS2ME'S TOTAL LIABILITY ARISING OUT OF THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (I) THE FEES YOU PAID KARTS2ME IN THE 12 MONTHS PRECEDING THE CLAIM, OR (II) $100. KARTS2ME IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
(d) Indemnity. You agree to indemnify and hold harmless Karts2Me from any claim, damage, or expense (including reasonable attorneys' fees) arising from your breach of these Terms, your violation of law, or your use of the platform, except to the extent caused by Karts2Me's own gross negligence or willful misconduct.
These Terms are governed by the laws of the State of Mississippi, without regard to its conflict-of-laws principles, except where federal law (including the Federal Arbitration Act, governing Section 2) applies. This selection reflects Q Squared LLC's principal place of business and has not yet been reviewed by counsel licensed in every state Karts2Me operates in.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with the Karts2Me Privacy Policy, constitute the entire agreement between you and Karts2Me regarding the platform.
Questions about these Terms, or written arbitration opt-out notices, may be directed to support@karts2me.com. Karts2Me is operated by Q Squared LLC. A registered mailing address will be added here once finalized.
